Please read these terms and conditions carefully before registering, uploading listings, or conducting inquiries on the Brand Estate SaaS platform.

1. Acceptance of Terms

Welcome to Brand Estate. By accessing, registering, or using our platform, mobile applications, or search directory databases (collectively, the "Services"), you agree to be bound by these Terms of Service (these "Terms"). If you do not agree to these Terms, you must immediately cease all access and use of our Services.

These Terms constitute a legally binding agreement between you and Brand Estate. We reserve the right, at our sole discretion, to modify or replace these Terms at any time.

2. User Accounts and Verification

To access certain features of the platform, such as inquiring about listings, listing properties, or viewing agent credentials, you must create a registered account.

2.1 Eligibility and Verification

  • Identity Verification (KYC): To maintain platform security, protect buyers, and prevent fraudulent inquiries, certain user roles (including Buyers, Agents, and Owners) must complete mandatory National Identity (NID) or government-issued photo identification verification.
  • Accuracy of Information: You agree to provide accurate, current, and complete information during registration.
  • Account Security: You are entirely responsible for safeguarding your login credentials. Brand Estate will not be liable for losses caused by unauthorized account access.

3. Real Estate Listings

Brand Estate provides a directory marketplace allowing registered Agents and Owners (Listers) to upload and publish property advertisements.

3.1 Listing Policies

  • Truth in Advertising: All listing specifications (such as pricing, amenities, zoning codes, and property dimensions) must be accurate, verified, and not misleading.
  • Zoning Compliance: Listers must specify the correct zoning reference codes (e.g. MU-R, O-C, I-L, W-D) in accordance with local municipality guidelines.
  • Approval Queue: Listings uploaded to the platform are subject to moderation and may remain in a "Pending Approval" state until verified by a system moderator. We reserve the right to reject or archive listings that violate our standards.

4. Fees, Payments, and Services

  • Application Fees: Prospective tenants submitting property lease applications may be subject to non-refundable application screening fees to cover background and credit scores auditing.
  • Subscription Packages: Premium packages (e.g. Bronze, Silver, Gold) grant advanced features like increased listing limits, virtual tours, and priority support. Subscriptions are billed in advance on a recurring monthly cycles.

5. Warranties and Limitation of Liability

BRAND ESTATE IS A PLATFORM PROVIDER, NOT A REAL ESTATE AGENT OR BROKER.

  • We do not represent or warrant the accuracy, safety, or legality of listings posted by third parties.
  • Any transaction, lease agreement, or negotiation is exclusively between the listing party and the prospective buyer/renter.
  • Under no circumstances shall Brand Estate be liable for any direct, indirect, incidental, or consequential damages resulting from your use of the platform.

6. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Brand Estate operates, without regard to conflict of law principles.
